Photo: MATTHEW GRAY By MATTHEW GRAY Benjamin Clifton Paul's tragic death had wider consequences that kept his case in the news for a good seven months after his burial at Waikumete Cemetery. Paul, a 47-year-old plumber, died after being knocked down by a tram along Ponsonby Rd on October 16, 1907. The New Zealand-born son of British migrants was on his way across the street in fading light when the accident occurred. An inquiry into his death took an unexpec- ted turn when a tram conductor named Holden claimed the brakes of the vehicle concerned were unreliable. Jurors called in to deliberate during the coronial inquest agreed and called on govern- ment inspectors to have a close look at the main- tenance of the entire Auckland fleet. Tramway officials were not impressed and summoned Holden to a special meeting. They claimed he'd gone out of his way to volunteer evidence in a case that did not directly affect him -- conse- quently bringing the ser- vice into disrepute. Hol- den was sacked. Trade unionist Arthur Rosser was highly criti- cal of the move at a time when discontent among tramway employees was high. The case was referred to the minister of justice, though whether Holden ever got his job back is unclear. Various reports suggest he didn't and he was still an ex-employee in May 1908 when colleagues went on strike citing several cases of unfair treatment at the hands of their masters. The braking systems of trams were again dis- cussed when, while reviewing Holden's dil- emma, Rosser high- lighted 17 similar cases of defectiveness reported by staff. None of this would have come as any conso- lation to Benjamin Paul's Grey Lynn-based family. His death left wife Caroline a widow at the age of 45 after 25 years of marriage. The youngest of their five children was 15.
